QwikTool – Terms & Conditions

General Rental Agreement

By renting equipment, tools, trailers, or related items from QwikTool (“QwikTool,” “Company,” “we,” “our,” or “us”), the renter (“Customer,” “Renter,” or “you”) agrees to the following Terms & Conditions. These terms apply to all reservations, rentals, deliveries, and equipment use.

1. Eligibility & Identification

• Renter must be at least 18 years of age and possess a valid government-issued photo ID.
• QwikTool reserves the right to refuse service or cancel reservations at its discretion.

2. Reservations & Payments

• Reservations are not guaranteed until confirmed by QwikTool.
• Full or partial payment may be required at the time of booking.
• A valid debit or credit card must remain on file during the rental period.
• Rental charges continue until equipment is returned, inspected, and accepted by QwikTool.

3. Delivery & Pickup

• Delivery service is available within approved service areas.
• Delivery and pickup times are estimates and may vary due to weather, traffic, equipment availability, or scheduling.
• Customer is responsible for ensuring safe and accessible delivery conditions.
• Additional fees may apply for inaccessible locations, waiting time, failed delivery attempts, or relocation requests.
• Unless otherwise agreed in writing, equipment must remain at the original delivery location.

4. Equipment Use & Responsibility

• Customer agrees to operate all equipment safely and only for its intended purpose.
• Equipment may only be operated by qualified and authorized individuals.
• Customer assumes full responsibility for:
  • Safe operation
  • Proper supervision
  • Compliance with all laws, permits, and regulations
  • Any injuries, damages, fines, or claims arising from use
• Customer shall not:
  • Sub-rent or loan equipment
  • Modify or alter equipment
  • Use equipment for illegal or unsafe purposes
  • Operate equipment under the influence of drugs or alcohol

5. Damage, Loss, & Theft

• Customer is fully responsible for any loss, theft, damage, misuse, neglect, vandalism, rollover, abuse, or destruction occurring during the rental period.
• Customer authorizes QwikTool to charge the payment method on file for:
  • Repairs
  • Cleaning
  • Missing parts
  • Tire damage
  • Fuel replacement
  • Excessive wear
  • Recovery costs
  • Diminished equipment value
  • Lost rental income during repairs
• Theft or major damage must be reported immediately to both QwikTool and local law enforcement.

6. Fuel, Cleaning & Return Condition

• Equipment must be returned in substantially the same condition as received.
• Customer may be charged additional fees for:
  • Excessive dirt or mud
  • Concrete, paint, or material buildup
  • Interior damage
  • Pet-related cleaning
  • Fuel replacement
  • Improper use or contamination
• Refueling and cleaning fees will be billed at current service rates.

7. Late Returns

• Late returns may result in additional half day minimum charge. The card on file will be billed or difference settled during return.
• Equipment not returned on time may be considered unlawfully retained property.
• QwikTool reserves the right to recover equipment without notice at the customer’s expense.

8. Weather & Outdoor Conditions

• Customer assumes all risk associated with weather, ground conditions, and terrain.
• No refunds or credits will be issued for weather-related interruptions unless approved by management.
• Equipment should not be operated in unsafe environmental conditions.

9. Mechanical Issues & Downtime

• Customer must immediately stop using equipment if a mechanical issue occurs and notify QwikTool.
• Unauthorized repairs are prohibited unless approved in writing.
• QwikTool’s liability for mechanical failure is limited to repair, replacement, or prorated rental adjustment at its discretion.
• QwikTool is not liable for project delays, labor costs, lost profits, or consequential damages.

10. Limitation of Liability

• QwikTool shall not be liable for any indirect, incidental, special, or consequential damages.
• Customer assumes all risk associated with equipment use, transportation, loading, unloading, and operation.
• Customer agrees to indemnify and hold harmless QwikTool from all claims, liabilities, damages, attorney fees, and expenses arising from the rental or use of equipment.

11. Prohibited Uses

Equipment may not be used:

• Outside approved operating limits
• For illegal activity
• For demolition unless approved
• In flooded or submerged conditions
• By untrained operators
• On unsafe slopes or terrain exceeding manufacturer recommendations

12. Rental Extensions

Rental extensions must be approved prior to the scheduled return time and are subject to equipment availability.

13. Cancellations & Refunds

• Reservation deposits may be non-refundable.
• Cancellations within 24 hours of delivery or scheduled pickup may be subject to cancellation fees.
• Special-order equipment or reserved delivery slots may require advance notice for refunds.

14. Governing Law

These Terms & Conditions shall be governed by the laws of the State of North Carolina. Any disputes arising from this agreement shall first be attempted to handle with QwikTools directly, if a solution can not be reached then it shall be handled in the appropriate courts located within North Carolina.

15. Acceptance of Terms

By signing a rental agreement, submitting payment, accepting delivery, or using rented equipment, Customer acknowledges that they have read, understood, and agreed to these Terms & Conditions.
